These terms cover your use of theagenttheycall.com, including the free website grade. The site is run by Darkhorse Traders LLC ("we," "us"). By using the site, you agree to these terms.
The website grade
The grade is an automatic first look at a public website, taken on a test phone at the moment you run it. It checks a handful of things we think matter to agents and their clients. It can be wrong. Websites change, load differently on different phones, and some things can only be checked by a person. The grade is information, not a promise, guarantee or professional advice, and it isn't a statement about the agent behind the website.
Please only grade websites you have a real reason to look at, such as your own or one you manage. Don't use the grade to run automated or bulk checks, to overload anyone's website, or to get around our limits.
Samples and examples
Sites labeled as samples, including the Morgan Hale sample site, are made up to show what we build. The names, people, homes and numbers on them are examples, not real clients or real results. Market figures on this site, like median sale prices, come from the public sources we name next to them and can change.
Our services
This site describes the websites and services we offer. Using the site, getting a grade or getting a preview doesn't create a contract. We only provide paid services under a separate written agreement you sign. Prices and package details on this site can change until they're in a signed agreement.
Your information
Our privacy policy explains what we collect and how we use it. Calls and texts are covered by our text message terms.
Our content
The site's design, text, graphics, photos and code belong to us or the people who licensed them to us. You can view and share links to the site. Please don't copy, resell or republish its content without our written permission.
Other companies' names, like brokerages and website platforms, belong to their owners. We mention them only to describe and compare. Mentioning them doesn't mean they endorse us or we're connected with them.
Things you agree not to do
- Break the law or anyone's rights using the site.
- Try to hack, overload, scrape or interfere with the site.
- Pretend to be someone else, or enter someone else's contact details without permission.
No warranties
The site and the grade are provided "as is" and "as available." To the extent the law allows, we make no warranties of any kind, including that they'll be accurate, uninterrupted or fit for any particular purpose.
Limit on our liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits or lost business, from your use of the site or the grade. If we're found liable for anything related to the site, our total liability is limited to $100. Paid services are covered by their own signed agreement, not this section.
Governing law
These terms are governed by the laws of the State of Arizona. Any dispute about the site will be handled in the state or federal courts located in Pima County, Arizona.
Changes
We may update these terms. When we do, we'll change the date at the top. Using the site after a change means you accept the new terms.
